IMPORTANT: READ THIS ENTIRE SHIPPING AGREEMENT CAREFULLY BEFORE PLACING AN ORDER.
By placing an order with us, you acknowledge that you have read, understood, and agree to be bound by this Shipping Agreement, as well as our separate User Agreement and Product Liability Disclaimer (which is incorporated by reference). If you do not agree, do not place an order.
This Shipping Agreement governs all aspects of order processing, shipping, delivery, and related matters for the product. It is designed to set clear expectations and limit our company’s liability to the fullest extent permitted by law.
1. Order Processing and Fulfillment
Orders are typically processed within 1-2 business days after payment confirmation (excluding weekends and holidays).
• Processing time may be longer during peak periods or due to unforeseen circumstances. We will make reasonable efforts to meet stated timelines but do not guarantee them.
• You will receive a shipping confirmation email with tracking information (if available) once your order ships.
2. Shipping Methods and Costs
• We ship via USPS
• Shipping costs are calculated at checkout based on your location, order weight, and selected method. Rates are subject to change.
• Free shipping may be offered on orders over a certain amount (if applicable); otherwise, you are responsible for all shipping charges.
• We ship only to the address provided at checkout. We are not responsible for orders shipped to incorrect addresses supplied by you.
3. Delivery Estimates and Risks
• Estimated delivery times are provided for informational purposes only and are not guaranteed. Actual delivery may vary due to carrier delays, weather, or other factors beyond our control.
• Title and risk of loss pass to you upon shipment from our facility (or our fulfillment partner’s facility).
• Once the product leaves our possession, we are not responsible for delays, loss, damage, theft, or other issues caused by the carrier.
4. Shipping Restrictions and International Orders
• We currently ship to the United States only
• Certain destinations may have shipping restrictions. We reserve the right to cancel or refuse any order that violates applicable laws or our policies.
5. Product-Specific Handling and Safety During Shipping
The product is a pressurized spray bottle containing grip-enhancing formula. To maintain product integrity and safety:
• Carriers handle packages according to standard procedures; we use appropriate packaging to minimize risk, but we cannot guarantee against all carrier mishandling.
• All other safety warnings from the User Agreement apply, including: DO NOT INGEST, DO NOT spray near the mouth, eyes, nose, or face, and use only as directed (bottle completely vertical with sprayer at the top).
6. Claims for Lost, Damaged, or Defective Shipments
• You must inspect the package upon delivery. Report any visible damage to the carrier immediately and notify us within [insert number, e.g., 48 hours] of delivery.
• For lost packages: Contact the carrier first using the tracking number. We will assist with claims where possible, but resolution is ultimately between you and the carrier.
• For damaged or defective Product: Contact us at grip.essentials1@gmail.com within 7 days of delivery with photos and order details. We may offer a replacement or refund at our discretion, subject to verification and our return policy.
• Claims must be made in writing. We are not liable for any consequential damages, lost profits, or other indirect losses arising from shipping issues.
7. Disclaimer of Shipping Warranties and Limitation of Liability
SHIPPING SERVICES ARE PROVIDED “AS IS.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING SHIPPING TIMES, DELIVERY, OR THE ABSENCE OF DAMAGE DURING TRANSIT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY SHIPPING-RELATED CLAIM IS STRICTLY LIMITED TO THE PURCHASE PRICE OF THE AFFECTED ORDER (OR THE COST OF RESHIPMENT/REFUND AT OUR OPTION). WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, EVEN IF ADVISED OF THEIR POSSIBILITY.
You assume all risks associated with shipping, including carrier performance. Misuse of the product after delivery (including failure to follow usage instructions) voids any potential claims.
8. Indemnification
You agree to indemnify, defend, and hold harmless from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:
• Your provision of incorrect shipping information;
• Your actions or negligence after delivery;
• Any misuse of the product; or
• Violations of this Shipping Agreement.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Illinois. Disputes shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
10. Changes and Entire Agreement
We may update this Shipping Agreement from time to time. Continued use of our services after changes constitutes acceptance. This Agreement, together with the User Agreement, constitutes the entire understanding between you and the company regarding shipping.
BY PLACING AN ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS, INCLUDING THE LIMITATIONS OF LIABILITY AND INDEMNIFICATION THAT PROTECT THE COMPANY.
